Tipper Solutions LLC – Terms & Conditions

Effective Date: August 2, 2025

1. Acceptance of Terms

By placing an order, accepting services, or having equipment delivered, you (“Customer”) agree to these Terms & Conditions (“Agreement”) with Tipper Solutions LLC (“Company”). This Agreement, including all service invoices and supplemental documents, constitutes the entire agreement between the Customer and the Company, superseding any previous or oral agreements.
By ordering services through Tipper Solutions LLC’s website, phone, email, or any other communication method, the Customer expressly agrees to abide by these Terms & Conditions.

2. Prohibited Items

For safety, legal, and environmental compliance, the following materials are strictly prohibited from being placed in any Tipper Solutions LLC trailer. Violations may result in additional charges, fines, or service refusal.

Absolutely Prohibited Items:

  • Liquids of any kind (this includes water, oils, paints, solvents, gels, fuels, resins, adhesives, insecticide, pesticide, etc.)

  • Paint (liquid or gel form) – Only completely dried paint on solid surfaces (e.g., dried on cardboard) is acceptable

  • Batteries (automotive or household)

  • Railroad ties

  • Asbestos or asbestos-containing materials

  • Industrial drums (empty or full)

  • Biohazardous or infectious waste (e.g., medical sharps, syringes, scalpels, IV bags)

  • Hazardous materials (including chemical products, pesticides, and herbicides)

  • Flammable, explosive, or radioactive substances

  • Contaminated soil or absorbent materials

  • Liquids, sludge, or semi-solid waste

  • Pressurized containers or tanks

  • Wet cement or concrete slurry

Accepted With Restrictions or Additional Fees:

  • Tires: $15 per tire – must be placed at the rear of the trailer

  • Appliances & Water Heaters: $30 per item – must be placed at the rear of the trailer

  • Roofing Shingles/Materials: Accepted up to 30 squares – must not exceed trailer’s weight limit – call ahead for confirmation

  • Concrete, Bricks, and Block: Accepted only with prior notice and limited to 3 cubic yards per trailer – customer must call ahead to confirm inclusion

Fire Policy:

Burning, igniting, or incinerating any waste inside the trailer is strictly prohibited. Violations will result in immediate service termination, disposal refusal, and liability for all resulting damages.

3. Waste Separation Requirement

To comply with Moore County, North Carolina landfill regulations and state/federal environmental laws, waste must be pre-sorted before loading into the trailer. Each trailer may contain only one of the following waste categories:

  • Leaf & Limb Waste

  • Household Waste

  • Construction & Demolition Debris

Mixing of waste types is strictly prohibited. Improper sorting may result in rejection of the load, re-sorting charges, additional fees, or refusal of service.

4. Equipment Use and Responsibility

Customer Responsibilities:

  • Equipment is provided “AS-IS” with no warranties, expressed or implied.

  • Customer shall inspect the trailer upon delivery and immediately report any damage or malfunction.

  • The trailer must be placed on stable, obstruction-free ground as designated by the customer.

  • Trailers may not be moved or relocated by the customer after placement without written permission from the Company.

Damage and Liability:

  • Customer accepts liability for any property damage caused by equipment placement, including damage to driveways, sidewalks, lawns, irrigation, septic, or underground utilities.

  • Customer is responsible for any damage to the trailer resulting from overloading, improper use, prohibited items, or unauthorized movement.

  • A $100 Dry Run/Trip Fee will be charged for blocked or inaccessible trailer pickup/drop-off.

5. Weight Limits and Disposal Fees

Maximum Weight:

  • Trailers must not exceed 8,000 lbs (4 tons) for transport safety and vehicle/trailer limitations.

  • Trailers over this weight will not be hauled. Tipper Solutions LLC reserves the right of service refusal for overweight or unsafe loads.

Disposal Rates (Applied After Exceeding Included Weight Limits):

  • Leaf & Limb Waste: $0.05 per pound

  • Household Waste and Construction & Demolition Waste: $0.06 per pound

  • (Rates may differ if otherwise stated on the customer’s invoice)

Overload & Volume Limits:

  • Waste must not exceed the height of the trailer’s top rail

  • Minimum $150 fee applies to overloaded trailers

  • Customers may be required to offload excess debris on-site to meet safety standards

6. Labor Services

Tipper Solutions LLC offers on-site loading labor upon request.

  • Rate: $25/hour per laborer

  • Minimum charge: 2-hour service per laborer

  • Labor does not include containers, bags, or packing supplies

Safe Lifting Policy:

  • Items weighing between 1–50 lbs may be handled by a single laborer, depending on the item's size, shape, and ease of access.

  • Items over 50 lbs should be lifted with proper technique and may require a second person or equipment assistance, based on field conditions and laborer discretion.

  • Items exceeding 75 lbs will generally require two-person lifting or customer-provided assistance for safe handling.

Labor services are billed separately from trailer rental and disposal charges unless otherwise agreed upon in a bundled invoice.

7. Payment Terms

  • Full payment for the basic dumpster rental service is required at the time of booking.

  • Disposal fees based on the final weight of materials will be billed at the conclusion of service.

  • Customers authorize all additional charges for weight overages, labor, damages, and violations

  • Late Payments: 5% penalty + 10% annual interest (compounded monthly)

  • Returned Checks: $50 returned check fee

8. Cancellations, Rescheduling & Refunds

  • Rescheduling: Allowed at no cost if requested by 3 PM the day before service

  • Cancellations: Eligible for refund if canceled by 3 PM the day before service

  • Refunds for Emergencies: May be granted for natural disasters, medical emergencies, or other extreme situations, minus a $30 processing fee

9. Dry Run and Trip Fees

  • A $100 dry run fee applies if the trailer cannot be delivered or picked up due to blocked access or customer error

  • Additional charges may apply for delays or complications caused by the customer

10. Permits

The customer is responsible for securing all necessary permits or local approvals for trailer placement or use. Lack of a permit does not exempt the customer from service charges or cancellation fees.

11. Indemnification

The Customer agrees to indemnify, defend, and hold harmless Tipper Solutions LLC and its members, agents, and contractors from all claims, damages, or legal actions arising out of:

  • Disposal of prohibited materials

  • Trailer overloading or improper use

  • Property damage or personal injury

  • Environmental violations or government fines

12. Governing Law and Arbitration

This Agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina. Any disputes will be resolved through binding arbitration, and the prevailing party may recover reasonable attorney fees and legal costs.

13. Force Majeure

Tipper Solutions LLC is not liable for service delays or failure to perform due to events beyond its control, including acts of nature, weather conditions, equipment failure, labor strikes, or government orders.

14. Assignment

Customers may not assign or transfer this Agreement to any other person or entity without written consent. Tipper Solutions LLC may assign this Agreement as necessary.

15. Use of Company Branding

Customers may not use Tipper Solutions LLC’s name, logo, or any intellectual property for advertising or promotional purposes without prior written approval.

16. Terms Subject to Change

Tipper Solutions LLC reserves the right to modify these Terms & Conditions at any time without prior notice. The most current version will always be made available on the Company’s website or included with customer invoices. Continued use of services constitutes acceptance of the updated terms.
